Terms of Service.

§1 General Provisions

 

These Terms and Conditions define the rules for Users to use the Website and the scope and types of services provided by Celus sp. z o.o. on the website www.celius.pl, as well as the basic principles regarding personal data protection and the Privacy Policy, as well as the complaint procedure. They constitute the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2017, item 1219, as amended).

 

By launching the Website, the Website page, or the relevant Service on the Website, the User consents to the Terms and Conditions and accepts the terms of these Terms and Conditions. By starting to use the Website or Service, the User accepts the provisions of the Terms and Conditions and undertakes to comply with them. The User acknowledges that ignorance of the rules and procedures contained in the Terms and Conditions does not constitute grounds for filing a complaint. To the extent not regulated in these Terms and Conditions, the provisions of Polish law shall apply to all legal relations arising from these Terms and Conditions.

The Terms and Conditions are available free of charge on the Website at www.celius.pl/regulamin-serwisu in a form that allows for downloading, reproducing, saving, and printing.

 

Every Website User is obligated to comply with applicable law and the provisions of these Terms and Conditions. In particular, it is prohibited to provide or process content through the Website that is inconsistent with applicable law.

 

The commercial information contained on the Website is for informational purposes only and does not constitute an offer within the meaning of the Civil Code.

 

§2 Definitions

The terms used in these Terms and Conditions shall have the following meanings:

 

Administrator - Celius sp. z o.o. with its registered office in Lublin at ul. Gospodarcza 26, 20-213 Lublin, KRS 0000834447, NIP 946 269 61 99. Celius sp. z o.o. is the controller of the personal data of a Client who is a natural person within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the Regulation).

 

Website - the website named celius.pl, enabling Internet users to use the Services available on the Website without the need to complete any formalities, in particular the requirement of prior registration (open resources).

 

User - any person using the Website in any way, in particular by using the Services provided by the Administrator.

 

Services - electronic services provided by the Administrator through the Website, the scope of which is specified in detail in § 3 of the Terms of Service.

 

Terms and Conditions - these terms and conditions, along with the Privacy Policy, are available at: www.celius.pl/regulamin-serwisu

 

Cookies - files containing data that can be sent from the Website to the User's browser and then stored on their system. The User can configure their browser to notify them of the receipt of cookies, while also providing the option to accept or reject them.

 

JavaScript - a computer program that facilitates access to and proper operation of selected websites.

§3 Scope of Services

The Administrator will provide the following Services free of charge via the Website:

 

providing materials and information on the Website, including, in particular, commercial information;

 

providing tools on the Website for Users to submit inquiries or requests to the Administrator, including, for example, contact forms.

 

The Administrator reserves the right to change the scope of Services provided on the Website at any time, in particular by adding new types of Services. Any changes to the scope of Services will be implemented in accordance with the rules for amending the Terms and Conditions.​

 

§4 Technical Requirements

 

To properly use the Website, the User must ensure that the following minimum technical requirements are met:

 

A computer and software with the following minimum technical specifications:

Operating system: Windows XP, 7, 8, and Mac OS X and OS X.

Web browser: Internet Explorer 8 (or newer), Google Chrome (version 28 or later), Mozilla Firefox (version 23 or later), Opera, Safari (version 5.1 or later), iOS Safari (version 4.0 or later), Android Browser 2.3.

 

JavaScript and Cookies enabled.

 

To display some elements and information, it may be necessary to install the following software: Flash Player, Quicktime, Acrobat Reader.

 

Internet access with a minimum bandwidth of 512 kb/s.

 

§5 Using the Website

Using the Services constitutes acceptance of the Terms and Conditions.

 

The User may terminate use of the Services at any time by leaving the Website.

 

 

§6 Intellectual Property Rights

 

The owner or entity authorized to use the copyrights to works within the meaning of the Act on Copyright and Related Rights posted on the Website, as well as the owner or entity authorized to use trademark rights, and the owner or entity authorized to use other intellectual property or industrial property rights to works posted on the Website, is the Website Administrator.

 

All rights to the website www.celius.pl and its individual elements are reserved. Use of the Website does not imply the acquisition by the User of any rights to the Website or its individual elements, except as expressly granted in the Terms and Conditions. The User has the right to use the Website for permitted personal use, including downloading, copying, or printing pages from the Website, provided that this does not violate the provisions of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws No. 90, item 631, as amended), rights arising from the registration of trademarks owned by the Administrator or used by the Administrator with the consent of authorized persons, or the provisions of the Act of 30 June 2000 - Industrial Property Law (Journal of Laws No. 119, item 1117). No part of the information contained on the Website may be used for commercial purposes, in particular by copying in whole or in part, without the prior written consent of the Administrator.

 

§7 Complaint Procedure

The User has the right to submit a complaint to the Administrator if the Services provided on the Website are not provided or are provided in a manner inconsistent with the provisions of the Terms and Conditions.

Complaint Procedure. Complaints regarding the Services may be submitted:

The complaint should include the following information:

User's name and surname,

contact details: telephone number and email address

a description of the problem giving rise to the complaint.

 

Complaints will be reviewed within 30 days from the date of receipt of the complaint by the Administrator.

 

If the Administrator does not respond to a complaint submitted by a User who is a consumer within the meaning of the Civil Code within the time limit referred to in paragraph 2, the complaint is deemed to have been accepted. The Administrator will provide the User, who is a consumer within the meaning of the Civil Code, with a response to the complaint on paper or another durable medium.

 

§8 Personal Data and Privacy Policy

 

Using certain Services available on the Website may require the User to provide personal data and consent to their processing by the Administrator. In such a case, the User's provision of personal data is voluntary, but it may be necessary to use a specific Service available on the Website. The User may withdraw consent at any time.

 

The Administrator is the controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the Regulation). The processing of User personal data by the Administrator will take place solely on the basis of the User's individual consent to the processing of their personal data by the Administrator, expressed on the Website. When the User provides personal data for the purposes of using the Website, the Administrator provides the User with all information referred to in Article 13 of the Regulation in a form that allows it to be saved on the User's data carrier and printed.

 

The Administrator processes User personal data in accordance with the provisions of the Regulation.

 

A User who is not a legal person or an organizational unit without legal personality, to which the law grants legal capacity, is allowed to exercise the following rights related to personal data processing within the Website's functionality:

the right to access personal data, consisting in receiving a copy of the personal data being processed (so-called extraction) – to exercise this right, please contact the contact details provided in § 7, paragraph 2 of the Terms and Conditions;

the right to rectify inaccurate personal data or request the completion of incomplete personal data when using the Service;

The right to object to the processing of personal data on the Website – to exercise this right, please contact us using the contact details provided in § 7, paragraph 2 of the Terms and Conditions.

The right to request the transfer of the data we process, i.e., you can receive it in a structured, commonly used, machine-readable format, and you have the right to transfer this data to another controller – to exercise this right, please contact us using the contact details provided in § 7, paragraph 2 of the Terms and Conditions.

The Administrator reserves the right to use online identifiers, i.e., cookies, which, by storing short text information on the User's device, allow for the monitoring of a given User's behavior on the eon.pl website. Each new user, upon entering the Website, will receive a message informing them about the processing of cookies on the Website (details at www.celius.pl/polityka-plikow-cookies). Cookies will be processed in accordance with the principles set out in the Privacy Policy available at www.celius.pl/polityka-plikow-cookies.

§9. Amendments to the Terms and Conditions

The Administrator reserves the right to decide on the content of information published on the Website, including making changes to all or part of the information contained on the Website and to periodically or completely withdraw information, part thereof, or the entire information resource of the Website from use on the Internet.

 

In the event of any amendments to the Terms and Conditions, they will be published on the Website before the effective date of the amendments, in the footer of the website www.celius.pl/regulamin-serwisu. Amendments to the Terms and Conditions take effect and are binding on Users upon their publication on the Website.

 

Failure to accept the new or amended Terms and Conditions constitutes a withdrawal from the use of the Services provided through the Website.

 

§10. Liability

 

The Administrator does not guarantee that it will be able to prevent downtime in the availability of the Website. The Administrator is entitled to interruptions or disruptions in the availability of the Website, in particular when:

This is caused by force major or third parties for whose actions or omissions the Administrator is not responsible,

The need to repair, expand, maintain, or modify the content of the Website or technical or hardware devices.

The Administrator is not responsible for the consequences of the User's use of the information and materials posted on the Website.

The Administrator is not liable for damages incurred by the User due to circumstances attributable to third parties.

In legally permissible cases, in relation to a User who is not a consumer within the meaning of the Civil Code, the Administrator is not liable for damages incurred by that User resulting directly or indirectly from the use, inability to use, or malfunction of the Website.

The Administrator is not responsible for any interruptions in the provision of Services resulting from failures or malfunctions of ICT Systems, for the proper functioning of which the Administrator is not responsible.

 

§11 Final Provisions

Any disputes arising between the User and the Administrator in connection with the provision of Services will be resolved by the court having jurisdiction over the Administrator's registered office. However, in the case of Users who are consumers within the meaning of the Civil Code, all disputes will be resolved by the competent common court.

Any disputes that may arise in connection with the provision of Services may be resolved amicably by the Administrator and the User who is a consumer within the meaning of the Civil Code, including, with the separate consent of the Parties, before the Permanent Consumer Arbitration Court at the Lublin Voivodeship Inspectorate of Trade Inspection in Lublin.

 

These Terms and Conditions come into effect on the date of their publication on the Website.
